1. Introduction
Welcome to CalmStoneLibrary ("we," "our," or "us"). These Terms & Conditions ("Terms") oversee your utilization of our yacht charter services and the website located at calmstonelibrary.site (the "Service") operated by CalmStoneLibrary.
Engaging with our charter service or using our Service equates to your acceptance of these Terms. Should you not consent to any segment of these terms, you are then ineligible to use the Service.
2. Service Overview
CalmStoneLibrary offers a selection of superior yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Services provided are contingent on availability and meteorological conditions. We hold the privilege to adjust or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, you are required to:
- Be at a minimum age of 18 years
- Submit valid and thorough details
- Provide payment for the necessary deposit as outlined in your reservation confirmation
- Comply with these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed exclusively after we receive payment and you obtain our confirmation in writing. We maintain the discretion to refuse our services to anybody.
3.3 Availability
All charters are offered subject to the availability of the vessel and agreeable weather conditions. We will put forth a diligent effort to meet your requested dates and times.
4. Payment Terms
4.1 Pricing
All prices are presented in € and encapsulate applicable taxes unless stated otherwise. Prices are open to revision without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost due at time of reservation
- Balance: Payable 48 hours in advance of the charter departure
- Supplementary charges (if applicable): Payable at the end of the charter
4.3 Payment Methods
We acknowledge major credit cards, wire transfers, and certified cheques. Payment processing is conducted using secure, encrypted protocols.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Greater than 72 hours prior to departure: Entire refund minus processing charges
- From 24 to 72 hours before departure: Refund of 50%
- Fewer than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
Should the weather be deemed unsafe by our captain, options available are to:
- Reschedule the charter to an alternative date at no extra charge
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If mechanical issues arise with the designated vessel, we will strive to arrange a comparable substitute. Should an alternative not be available, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Adhere to all directives from the crew
- Utilize safety gear as instructed
- Disclose any medical conditions that may impact their safety
- Stay within the allocated areas of the vessel
6.2 Prohibited Items
The following items are prohibited onboard:
- Glassware
- Illegal substances
- Firearms or other weapons
- Excessive amounts of beverages (beyond reasonable amounts)
- Pets (unless pre-approved)
6.3 Conduct
Passengers are to behave respectfully. We reserve the authority to terminate a charter with no refund should passenger conduct endanger safety or disturb others.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the charter's payment. We are not accountable for:
- Injuries sustained due to passenger negligence
- Loss or harm to personal belongings
- Indirect, incidental, or punitive losses
- Delays resulting from meteorological factors or situations beyond our supervision
7.2 Insurance Coverage
We uphold broad marine insurance encompassing our vessels and operations. Passengers should have their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our charter services signifies your acceptance of the inherent risks associated with marine activities and you take responsibility for your safety and actions.
8. Modifications and Itinerary Changes
We reserve the autonomy to alter itineraries, courses, or schedules due to weather factors, safety reasons, or operational necessities. We will endeavor to offer equivalent alternatives whenever possible.
9. Force Majeure
Any delay, cancellation, or change brought about by events not within our control, including, but not restricted to, are not our liability:
- Adverse weather
- Natural catastrophes
- Governmental regulations
- Port blockages
- Technical failures
10. Privacy and Data Protection
Your private data will be managed as per our Privacy Policy. By engaging with our services, you consent to our data collection and usage as delineated in said Privacy Policy.
11. Intellectual Property
Material on our website including text, visuals, emblems, and pictures, is protected by copyright and intellectual property regulations. You may not broadcast, disseminate, or create derivatives without our explicit consent.
12. Governing Law
The laws of Greece are the authority governing these Terms. Any disputes will be settled in the courts of Athens, Greece.
13. Changes to Terms
We may modify these Terms occasionally. Any alterations will be communicated via our website with a revised revision date. Your continued service use indicates your accord with the amended terms.
